Richard Romero, the Artist, has been hired to create art by hand from photographs and instructions supplied by you, the customer.
Our service has an average turnaround of 2 to 4 weeks from the moment we receive your photograph, instructions and any required layout approval. Every effort is made to fulfill every order within this period of time. However, given the artistic nature of the services provided, failing to deliver the artwork within the specified timeframe, does not constitute a reason for a refund or compensation of any form.
If you need the artwork by a specific date that falls outside our normal leadtime, an additional express fee will be required. If we approve your requested delivery date, and we fail to deliver by that date, then you will be entitled to a refund of the express service fee only
The Artist is not responsible for delays caused by the customer, such as: delays in sending the photographs, delays in responding to approval e-mails, inability to contact the customer due to wrong or incorrect contact information, or any other delays which results from the Artist having to wait for information, approval, confirmation or any other information from the customer.
The customer also understands that we are not responsible for delays caused by reasons beyond our control, such as: lost or delayed mail, server errors resulting in undelivered e-mails, delays in the drying of the paintings due to bad weather, Acts of God, or any other reason beyond the artist's control.
Richard Romero has a 100% satisfaction guarantee, which reads as follows: If customer is not satisfied with the Artist's work he can cancel the service at any time under the next conditions: Cancellation. Should Customer choose to cancel work after commencement, The Artist agrees to refund customer 100% of the final fees if the cancellation occurs after sketches; 75% of the final fee if cancellation occurs after revised sketches; and 50% of the final fee if cancellation occurs after final art. If after receiving your painting or drawing you are not completely satisfied with it, simply return it for a 50% refund - you pay the cost of shipping the portrait back to us. Please ship the painting and/or drawing to: Richard Romero, 1014 Madison Ave. Paterson NJ, 07501. We must receive the returned artwork within 15 days of the customer receiving the actual piece. (Shipping charges, if any, are non refundable). This policy is subject to the terms and exceptions set forth in the present "Terms & Conditions" document. Richard Romero reserves the right to refuse refund requests to customers abusing this policy.
The customer understands that the service ordered is done by hand by human beings, and as such, the customer should have a margin of tolerance when it comes to the resemblance of the images portrayed in the artwork ordered.
The customer understands that the depiction of the subjects portrayed in the artworks can only be as good as the quality of the photographs submitted. Therefore, it is the customer's responsibility to submit clear, high resolution photographs, and clear, self-explanatory instructions with their orders.
If the Artist feels a quality artwork cannot be created due to poor, old, blurred, or low resolution photograph(s), confusing or unclear instruction(s), inadequate layout or any other special request that the artist's expertise determines can't be used towards a good portrait or artwork, then the artist will notify the customer to send clearer photograph(s), to explain the instructions further and/or to select a more appropriate layout. If the customer is unable to provide better photos, unable to provide clearer instructions or unwilling to agree to a better layout, the customer understands that the artwork might not be as good as the usual level of quality. If, after such notice, the customer decides to proceed with the order without any changes, then any cancellation or refund requests resulting from an unsatisfactory artwork will not be honored.
The Artist will show a preview of the artwork to the customer within 10-15 business days of order. These days are counted from the day we receive all photos, instructions and layout approvals needed to begin your work. Artworks consisting of combinations of several images into one, or artworks of exceptionally high difficulty, will take longer. The preview will consist of a digital photograph of the finished artwork which will be sent by e-mail as an attachment.
After receiving the preview, the customer has the right to request improvements, modifications or revisions. These requests must be in accord with the customer's original instructions. The customer can't request to change the photo, change the subjects' pose, change the background, change the orientation of the artwork, or any other requests that were not mentioned in the original instructions.
The customer understands that the Artist can only work from the material and instructions supplied by the customer in a timely manner. For example, if the customer sends a photo in which the subject has a beard, and the customer wants the beard removed, then the customer should request so at the moment the order is placed. The customer can't request to have the beard removed after work has started.
The customer understands that the Artist does not know the people in the photographs in person, and that optical illusions may cause the people to look different in the photographs than they are in real life. For example, if due to bad lighting, bad pose, bad angle, bad focus, the person in the photograph appears to have a different hair color, a different eye color, a different skin complexion, shadows that appear to be facial hair, or lines that appear to be extra wrinkles or double chins, the Artisti has no way of knowing the person's real life appearance, unless the customer explicitly explains the situation when sending the photograph.
These terms and conditions represent the full agreement between the Artist, Richard Romero and the customer, and are subject to change without notice. Any modifications or addendums to this agreement for any specific order must be explicitly approved by Richard Romero, before the order is placed.
